BriefLink does not provide legal advice, legal services, or legal representation. Use of BriefLink does not create an attorney-client relationship, and BriefLink is not a law firm. BriefLink does not guarantee that any brief is formatted properly for any court.
Although BriefLink endeavors to process uploaded materials accurately, all output is generated automatically and may contain omissions, formatting defects, citation errors, hyperlink errors, transcription errors, or other inaccuracies. Users are solely responsible for carefully reviewing, verifying, proofreading, and approving all work product before filing, serving, publishing, relying on, or otherwise using it. Users must independently confirm all citations, quotations, page references, hyperlinks, cross-references, formatting, and substantive content.
Security of Uploaded Materials
BriefLink uses security measures designed to protect uploaded files and related information, including encryption for data in transit and/or at rest, as applicable. However, no system can be guaranteed to be completely secure. Users acknowledge that uploaded files and related information may be subject to risks beyond BriefLink's control, including, without limitation, unauthorized access, interception, disclosure, alteration, loss, corruption, or other security incidents arising from events or processes beyond BriefLink's reasonable control. BriefLink does not warrant or guarantee the absolute security of any uploaded materials, transmitted information, or stored data.
HIPAA-Related Information
To the extent any uploaded materials or information may constitute or contain protected health information or other information covered by the Health Insurance Portability and Accountability Act of 1996, as amended, or its implementing regulations ("HIPAA"), BriefLink has implemented security measures intended to protect such information, including encryption and related safeguards, where applicable. However, BriefLink does not guarantee the complete security, privacy, or confidentiality of any HIPAA-covered information and disclaims responsibility for unauthorized access, disclosure, or other events beyond its control. Users are solely responsible for ensuring that their use of BriefLink complies with all applicable privacy, confidentiality, and healthcare information requirements.
To the fullest extent permitted by applicable law, BriefLink disclaims any and all liability for any loss, damage, cost, expense, claim, sanction, penalty, or consequence of any kind arising out of or relating to use of the service, any uploaded materials, any generated output, any security incident, or any reliance on such output, whether based on contract, tort, negligence, strict liability, or any other theory of liability. If any such liability does exist beyond this disclaimer, such liability is limited to the full price paid for the service by the user for the brief at issue.
Indemnification
As a condition of using BriefLink, the user agrees to defend, indemnify, and hold harmless BriefLink, its affiliates, officers, directors, employees, agents, contractors, successors, and assigns from and against any and all claims, demands, actions, causes of action, liabilities, damages, judgments, losses, penalties, fines, costs, and expenses, including reasonable attorneys' fees and litigation expenses, arising out of or relating to:
- the user's uploaded files or other materials;
- the user's use of BriefLink or any generated output;
- any alleged or actual error, omission, infringement, misstatement, defamation, privacy violation, security incident, or other claim resulting from materials uploaded by the user or work product generated through the service; or
- the user's violation of this disclaimer, the terms of service, or applicable law.
Acceptance of Terms
By signing below, the user acknowledges that the user has read this disclaimer, understands it, and agrees to be legally bound by all of the terms, conditions, limitations, disclaimers, and indemnification provisions set forth above.
This disclaimer is intended to be as broad and inclusive as permitted by applicable law. If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.
